Agreement to Terms

Welcome to SnapBites! These Terms of Service ("Terms") constitute a legally binding agreement between you and HaPo Tech LLC ("Company," "we," "our," or "us") concerning your access to and use of the SnapBites mobile application (the "App") and related services (collectively, the "Service").

BY USING OUR SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

Eligibility

To use the Service:

  • You must be 18 years or older to create an account
  • All users must comply with these Terms

You represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • You are at least 18 years of age
  • You will provide accurate information and keep it updated

Account Registration and Security

Creating an Account:

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining account confidentiality
  • You must notify us immediately of any unauthorized access

Account Responsibility:

  • You are responsible for all activity under your account
  • You must not share account credentials with others
  • You must use a strong, unique password

Acceptable Use

You agree to:

  • Use the Service only for lawful purposes
  • Provide accurate information about food consumption and nutrition
  • Respect the privacy and safety of others
  • Comply with all applicable laws and regulations

You agree NOT to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to hack, reverse engineer, or compromise security
  • Harass, abuse, or harm others
  • Use automated tools (bots, scrapers) without permission

Content and User Data

Your Content:

  • You retain ownership of content you upload (food photos, notes, etc.)
  • You grant us a license to use, store, and process your content to provide the Service
  • You are responsible for the accuracy of information you provide

Prohibited Content: You may not upload content that contains personal information of others without consent, is illegal or harmful, infringes on intellectual property rights, or promotes illegal activities.

Intellectual Property Rights

The Service and its content (excluding user content) are owned by HaPo Tech LLC and protected by copyright laws, trademark laws, patent laws, and other intellectual property rights.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App on your personal device for personal, non-commercial purposes.

Subscription and Payment Terms

Free and Paid Features:

  • Basic features are available for free
  • Premium features require a paid subscription
  • Pricing is displayed in the App and may change with notice

Subscription Terms:

  • Subscriptions automatically renew unless canceled
  • You can cancel anytime through your device's app store

Payment Processing: Payments are processed through Apple App Store or Google Play Store. We do not store credit card information.

Medical Disclaimer

NOT MEDICAL ADVICE: The Service provides nutritional tracking and information for educational purposes only. It is NOT intended to diagnose, treat, cure, or prevent any disease or replace professional medical advice.

Important:

  • Always consult qualified healthcare professionals for medical advice
  • Do not rely solely on the App for medical decisions
  • AI-generated nutritional analysis may contain errors
  • Emergency situations require immediate professional help

No Doctor-Patient Relationship: Use of the Service does not create a doctor-patient relationship.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

HaPo Tech LLC SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Lost profits or revenue, loss of data, business interruption
  • Any damages arising from your use or inability to use the Service

Maximum Liability: Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the past 12 months.

Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless HaPo Tech LLC from any claims, liabilities, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of others.

Dispute Resolution

Governing Law: These Terms are governed by the laws of the United States.

Informal Resolution: Before filing a claim, contact us at legal@snapbites.ai to attempt informal resolution.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.

Termination

Your Rights: You may stop using the Service at any time and delete your account through App settings.

Our Rights: We may suspend or terminate your access immediately for violation of these Terms, illegal activity, or security concerns.

Modifications

We reserve the right to modify the Service or these Terms at any time. Material changes will be notified via email or in-app notification.
